1. 本私隱政策（「私隱政策」）旨在幫助用戶了解有關 山河亞太有限公司（「Good Mask」）如何收集、使用和分享由Good Mask或Good Mask的第三方服務供應商可能透過從用戶使用Good Mask的訂購平台時所收集到的資料。

2. 於本私隱政策裏，Good Mask將會統稱Good Mask的網站、訂購平台及手機應用程式，所有相關的支援及與用戶的互動為「Good Mask的服務」。當使用Good Mask的服務時，便已代表用戶同意本私隱政策的條款。

3. 當用戶與Good Mask互動服務時，Good Mask可能收集並存儲由用戶所提供的 「個人資料」、「非個人資料」及「財務資料」（統稱為「資料」）。
3.1「個人資料」是指專門識別個體的資料（如姓名、郵寄地址、GPS定位、電郵地址或電話號碼）。
3.2「非個人資料」是指有關用戶的資料，但該資料不能識別一個特定的個體（例如人口統計信息、使用數據、設備的硬件和軟件的數據、廣泛地理位置及下載歷史等）。
3.3「財務資料」是指與付款和賬單相關的資料（例如：姓名、賬戶資料、賬單地址等）。

4. Good Mask可使用資料於下列用途：
4.1用戶賬戶及記錄的申請、成立、運作及行政管理。
4.2處理意見、查詢及投訴。
4.3 處理訂購、賬單、付款及送貨。
4.4識別及核實身份。

5. 當用戶連接到第三方服務供應商及與Good Mask聯繫時，Good Mask便會透過用戶使用Good Mask的服務收集資料。以下是Good Mask可能收集資料的幾個例子：
5.1 當用戶通過電話、電子郵件、Good Mask的聯繫頁面或其他聯繫方式聯繫Good Mask。
5.2 當用戶在Good Mask的服務建立一個賬戶。
5.3 當用戶於或透過Good Mask的服務購買貨品。
5.4 當用戶與Good Mask的第三方服務供應商互動時。

6. 資料的提供完全是自願性質。然而，如用戶選擇不向Good Mask提供資料，則Good Mask可能無法為用戶提供有關的資訊或服務，或處理用戶的要求。

6.2 Good Mask的服務可能包含其他非由Good Mask擁有或控制的其他網站連結。請注意，Good Mask並沒有該些網站的控制權及並不會為該些網站的私隱保護措施負上責任。本私隱政策僅適用於由 Good Mask的服務收集的資料。

7. 一般而言，Good Mask採取行內公認的標準，以保障或防止未經授權的資料查閱或披露，這包括但不限於，確保所有的個人資料和財務資料通過加密連接收集（使用「SSL技術」），並只披露「需要知道」基礎下的資料。但Good Mask無法百份百保證資料的絕對安全性，因為現時並沒有互聯網傳送方法或電子存儲100%安全的保安方法。雖然第三方的收集和使用資料並不包括在本私隱政策內，Good Mask會採取合理的商業措施，以確保Good Mask的第三方服務供應商遵守本私隱政策的條款，但Good Mask不會為可能會接收該資料的任何第三方的任何行為承擔或負上責任。

8. Good Mask收集信息的主要理由是為用戶提供Good Mask的服務，提高Good Mask的服務質素以及就有關用戶使用Good Mask的服務與用戶溝通。Good Mask不會在未經用戶同意下向第三方出售或洩露用戶的資料，以下是Good Mask使用用戶資料的幾個例子：
8.1 Good Mask可能會使用用戶的個人資料就有關Good Mask的服務與用戶聯繫。對於重要的信息，通知或有關Good Mask的服務的變更，Good Mask會對用戶保留聯繫的權利。
8.2 Good Mask可能使用資料就有關不法活動，有嫌疑的詐騙，及一些涉及潛在對任何人士的人生安全威脅，違反Good Mask的相關條款及細則又或根據法律需要去調查，阻止或採取行動。

9. Good Mask保留其自行決定及並沒有限制去披露非個人資料的權利。但是，Good Mask不會透露用戶的個人資料及財務資料，除以下情況外：
9.1 Good Mask可能會就任何上文第8條所列情況分享資料。
9.2 第三方服務提供商。
9.2.1 Good Mask可能會使用第三方公司和個人代表Good Mask履行職責，例子包括履行訂單，處理付款，託管，數據存儲，發送郵件和電子郵件，除去客戶名單裏的重複資訊，分析數據，提供搜索結果和連接（包括付費列表和連接），處理信用卡付款，及提供客戶服務。Good Mask會向這些實體提供他們可以履行其職責之相關資料的查閱權力。但Good Mask會採取措施，以確保他們不得使用該資料於其他目的上 。
9.3 法律。
9.3.1 Good Mask可能需要為了回應法庭命令和其他法律程序披露信息，或建立/行使Good Mask的法律權利。Good Mask也可能會披露用戶的信息以應對法律訴訟，當Good Mask認為披露是為了保護Good Mask的權利，保護用戶的安全或他人的安全，調查欺詐行為，或者向政府請求做出回應。
9.4 徵得用戶的同意。
9.4.1 可能有其他的情況下，Good Mask或用戶可能希望允許披露有關用戶的個人資料及財務資料。Good Mask會先取得與用戶的同意才進行披露。

10. Good Mask的服務是在香港特別行政區（「香港」）設置的。如果用戶是來自歐盟、美國、加拿大或其他任何地區使用Good Mask的服務時，而這些國家或地區對於個人資料的收集、使用及披露的相關法律或法規與香港有不同時，請注意，基於用戶是傳送用戶的個人資料到香港，因此並不會享有與其他國家法律的同等保障。

11. 本文所述的條款和條件以及合同引起的任何爭議或事項均應受香港法律管轄並據其解釋。用戶和Good Mask都應服從香港法院的非專屬管轄權。

12. 如有任何爭議Good Mask保留最終決定權利。Good Mask可按其絕對酌情權修改本私隱政策。

1. This privacy policy (“Privacy Policy”) is designed to help User understand how Shan Ho Asia Pacific Limited (“Good Mask”) collects, uses and shares information that Good Mask or Good Mask’s third-party service providers may collect from users when User accesses Good Mask’s Platform.

2. For the purposes of the Privacy Policy, Good Mask will call Good Mask’s ordering platform, mobile apps and all corresponding support and interactions with User the “Good Mask’s Service”. By using the Good Mask’s Service, User agrees to the terms of this Privacy Policy.

3. Good Mask may receive and store Personal Information, Non-Personal Information and Financial Information (collectively “Information”) that User provides when User interacts with Good Mask.

1. “Personal Information” is information that specifically identifies an individual (e.g. name, mailing address, GPS location, email address or phone number).
2. “Non-Personal Information” is information about an User, but by itself does not identify a specific individual (e.g. demographic information, usage data, device hardware and software data, broad geographic location, and download history).
3. “Financial Information” is information relating to payments and billings (e.g., name, account information, billing address).

4. Good Mask may use the Information for the following purposes:

1. For application, creation, operation and administration of accounts and records for User.
2. To handle comments, enquiries and complaints.
3. To process orderings, billings, payments and deliveries.
4. For identification and verification purposes.

5. Good Mask collects Information through User’s use of the Good Mask’s Service, when User connects to third-party service providers, and communication with Good Mask. Here are a few examples of when Good Mask may collect Information:

1. When User contacts Good Mask by phone, email, Good Mask’s contact page or other means.
2. When User creates an account on the Good Mask’s Service.
3. When User purchases products or services in or through the Good Mask’s Service.
4. When User interacts with Good Mask’s third-party service providers.

6. The provision of the Information is voluntary. However, if User elects not to provide the Information to Good Mask, Good Mask may not be able to supply User with the relevant information or services or to process User’s request.

1. By using the Good Mask’s Service, User is consenting to Good Mask collecting Non- Personal Information without any further permission or notification. Good Mask may collect Non-Personal Information directly from User, through Good Mask’s third-party service providers, or automatically through tools including, but not limited to, cookies, web beacons and analytics programs embedded within the Good Mask’s Service. 2. The Good Mask’s Service may contain links to other sites that are not owned or controlled by Good Mask. Please be aware that Good Mask have no control over these sites and is not responsible for the privacy practices of such other sites. This Privacy Policy applies only to Information collected by the Good Mask’s Service.

7. Good Mask follows generally accepted industry standards to protect against or prevent unauthorized access to or disclosure of the Information. For Good Mask, this includes, but not limited to, ensuring that all Personal Information and Financial Information is collected via encrypted connection (using secure socket layer technology “SSL”) and is disclosed only on a “need to know” basis. That said, Good Mask cannot guarantee absolute security of Information because no method of transmission over the Internet or electronic storage is 100% secure. And while the collection and use of Information by third-party is not covered by this Privacy Policy, Good Mask does take commercially reasonable measures to ensure Good Mask’s third-party service providers comply with the terms of this Privacy Policy, but Good Mask is not responsible and liable for any actions of any third-parties that may receive any of such Information.

8. The primary reasons Good Mask collects Information are to provide the Good Mask’s Service, improve Good Mask’s service standard and communicate with User regarding User’s use of the Good Mask’s Service. As a general matter, Good Mask does not sell and typically will not disclose User’s Personal Information to third-parties without User’s consent. Here are a few examples of what Good Mask does with Information:

1. Good Mask may use User’s Personal Information to contact User about the Good Mask’s Service, and Good Mask reserves the right to contact User with respect to important information, notices or changes relating to the Good Mask’s Service.
2. Good Mask may use Information in order to investigate, prevent or take action regarding illegal activities, suspected fraud, and situations involving potential threats to the physical safety of any person, violations of Good Mask’s terms and conditions or as otherwise required by law.

9. Good Mask reserves the right to disclose Non-Personal Information at its discretion and without limitation. However, Good Mask will not disclose User’s Personal Information or Financial Information except in the following circumstances:

1. Good Mask may share Information in relation to any of the situations listed in Clause 8 above.

2. Third-Party Service Providers.

1. Good Mask may use third-party companies and individuals to perform functions on Good Mask’s behalf. Examples include fulfilling orders, processing payments, hosting, data storage, sending postal mail and email, removing repetitive information from customer lists, analyzing data, providing search results and links (including paid listings and links), processing credit card payments, and providing customer service. Good Mask will provide such entities with access to Information needed to perform their functions, but will take measures to ensure that they may not use it for other purposes.

3. Legal.

1. Good Mask may disclose Information to respond to court orders and other legal process, or to establish/exercise Good Mask’s legal rights. Good Mask may also disclose User’s Information to defend against legal claims when Good Mask believes that disclosure is necessary to protect Good Mask’s rights, protect User’s safety or the safety of others, investigate fraud, or respond to a government request.

4. With User’s Consent.

1. There may be additional instances where User or Good Mask may wish to allow disclosure of Personal Information and Financial Information about User. Good Mask may make such disclosures with User’s consent.

10. The Good Mask’s Service is hosted in Hong Kong Special Administrative Region (“Hong Kong”). If User is accessing the Good Mask’s Service from the EU, US, Canada, or any other regions with laws or regulations governing the collection, use, and disclosure of personal information, that differ from the laws of Hong Kong, then please note that User is transferring User’s personal information to Hong Kong which does not have the same information protection laws as other regions.

11. The terms and conditions as set out herein and any dispute or matter arising from the Contract shall be governed by and construed in accordance with the laws of Hong Kong. Both User and Good Mask shall submit to the non-exclusive jurisdiction of the Hong Kong courts.

12. Good Mask has the absolute discretion to revise this Privacy Policy. In the event of any dispute hereunder, Good Mask’s decisions shall be final and conclusive.
